Justices hear "Bong Hits 4 Jesus" case



WASHINGTON (AP) -- A high school principal was acting reasonably and in accord with the school's anti-drug mission when she suspended a student for displaying a "Bong Hits 4 Jesus" banner, her lawyer told the Supreme Court Monday.

"The message here is, in fact, critical," the lawyer, former independent counsel Kenneth Starr, said during a lively argument about whether the principal violated the constitutional rights of the student.

On the other side, attorney Douglas Mertz of Juneau, Alaska, urged the justices to see the case as being about free speech, not drugs. (Watch why "bong hits" are on the court's plate )

The dispute between Joseph Frederick, who in 2002 was a high school senior, and principal Deborah Morse has become an important test of the limits on the free speech rights of students.

LOS ANGELES: It has been billed as the most important student free-speech case since the Vietnam War. The justices of the US Supreme Court are poised to decide whether a school was wrong to punish a student for displaying a banner reading "Bong hits for Jesus".

Five years ago Joseph Frederick, then an 18-year-old student at a high school in Juneau, Alaska, spelled out the phrase in gaffer tape on a four-metre banner. His aim, he said, was to get on television as the Olympic torch for the 2002 Salt Lake City Winter Olympics passed through town - and to annoy his principal.

For years, people in less than a dozen states have been smoking medical marijuana to help cope with such things as brain tumors and multiple sclerosis. The federal government, however, sees such attempts at pain relief as selfish. These people are undermining the war on drugs, the feds say. And, last week, the Supreme Court agreed. In a 6-3 ruling, the court confirmed that federal anti-drug laws overrule state medical marijuana laws. Federal power is far more important than some cancer-havin’ stoner’s excruciating pain. So now the feds can feel free to bust anyone who smokes, grows, prescribes, or distributes medical marijuana, even if they live in one of the few states where doing so was approved democratically.

Angel Raich Loses Medical Marijuana Appeal / US Government Has No Compassion

When will this government realize that the people have spoken and they want the "Medical Marijuana Laws" passed?
They need to realize that the outdated laws concerning Marijuana are total bullshit. I wonder if most people realize that Marijuana is put in the same class as Heroine and Meth? The highest class you can get on the drug class list. That’s insane considering how mild of a drug it is compared to the rest of the drugs in that class.
The number of arrests and jail/prison sentences are skyrocketing day by day and that fills the jails and prisons so they need more space to lock-up the real criminals who deserve to be there. The prison game is big money in this country and the taxpayers are suffering because of it.
Wake-up Washington and do something about these insane drug laws before everyone is in prison for smoking a joint... BJC



Calif. appeals court rules against dying woman in medical marijuana case



SAN FRANCISCO - A woman whose doctor says marijuana is the only medicine keeping her alive can face federal prosecution on drug charges, a federal appeals court ruled Wednesday.

The ruling was the latest legal defeat for Angel Raich, a mother of two from Oakland suffering from scoliosis, a brain tumor, chronic nausea and other ailments who sued the federal government pre-emptively to avoid being arrested for using the drug. On her doctor’s advice, Raich eats or smokes marijuana every couple of hours to ease her pain and bolster her appetite.

SAN FRANCISCO, March 14 — Federal appellate judges here ruled Wednesday that a terminally ill woman using marijuana was not immune to federal prosecution simply because of her condition, and in a separate case a federal judge dismissed most of the charges against a prominent advocate for the medicinal use of the drug.

U.S. Teens Turning to Store-bought Highs


In a "good-news-bad-news" twist to the war on drugs, the Office of National Drug Control Policy (ONDCP) reports that U.S. teens are turning away from use of street drugs like marijuana and cocaine, in favor of abusing prescription drugs, and over-the-counter cough and cold medicines.
According to the ONDCP report, Teens and Prescription Drugs (.pdf), while illegal drug use among teens has dropped by 23 percent over the last five years, the number of new teen abusers of prescription drugs have caught up with new users of street drugs.

LANCASTER -- You’ve forgotten about those leftover painkillers in the back of your medicine cabinet, but your teen may not have. Almost 600 Lancaster County youth in grades 6 through 12 have illegally used prescription pain medications (such as Vicodin® and OxyContin®) in their lifetimes, ac-cording to the 2005 Pennsylvania Youth Survey. Even more have abused stimulants, such as Ritalin®, intended to treat attention deficit disorder, while 350 misused tranquilizers (such as Xanax® and Valium®).

Prescription Drug Abuse A Growing Problem


According to Follansbee police, prescription drug abuse is a growing problem in the Ohio Valley.

Officers said a number of people try to file false reports that their prescription drugs were stolen.
Now, officers require those people to take lie detector tests but said people rarely show up for the polygraph.
Because of pain pill theft and forged prescriptions, pharmacists said they must keep an eye on their customers.

Aldo Crisante of the Follansbee Pharmacy said, "We don't treat anyone as a criminal, but if we're not familiar with them, we may give them another glance. We're also familiar with doctors' handwriting. We look for strange quantities of the medication."

QB Michael Vick's water bottle being tested for marijuana

Jan. 18 (Bloomberg) -- Atlanta Falcons quarterback Michael Vick is being investigated after signs of marijuana were found in a water bottle he carried at an airport security check, according to a police report.
The bottle, with a hidden compartment that had ``a pungent aroma closely associated with marijuana,'' was taken from a recycling bin at Miami International Airport yesterday, the report by Miami-Dade Police said. A substance, described as ``a dark particulate,'' was sent to a lab for analysis, which might take three months, police said.
Vick, 26, a passenger on an Air Tran flight from Miami to Atlanta yesterday, wasn't arrested. He surrendered the bottle and passed through security before the substance was found, police said. Vick wasn't available for comment and agent Joel Segal didn't return a message left on his mobile phone.
``Right now we're waiting for the lab results,'' police spokesman Alvaro Zabaleta said in a telephone interview. ``Depending on those results, we'll then determine where the investigation goes next.''
The National Football League Falcons said in a statement that they ``plan to look into this matter and discuss it further with Michael before having any further comment.''
NFL spokesman Greg Aiello didn't immediately return a phone call seeking comment.
